Terms of Service

These Terms of Service govern your use of SMS Mobilo (the “Platform”). By creating an account or sending messages through the Platform, you agree to these terms. If you do not agree, do not use the Platform.

1. Your Account

You must provide accurate information when registering. You are responsible for all activity that occurs under your account, including messages sent and credits spent. Do not share your login credentials or API keys with people who should not have access to your account.

We may suspend or close accounts that are inactive for more than 12 consecutive months, or that are found to be in breach of these terms.

2. Credits and Payments

The Platform operates on a prepaid credit model. Credits are purchased via MoMo (MTN or Airtel) and deducted per SMS part sent. One credit equals one standard SMS part (160 characters in GSM-7, 70 characters in Unicode).

  • Credits do not expire as long as your account remains active.
  • Purchased credits are non-refundable once consumed by sent messages.
  • Unused credits on a closed account may be refunded at our discretion — contact support to request this.
  • We reserve the right to adjust credit pricing with at least 14 days’ notice.

3. Acceptable Use

You may use the Platform to send SMS messages that are lawful, accurate, and have a legitimate business purpose. You must not use the Platform to:

  • Send unsolicited commercial messages (spam) to recipients who have not opted in.
  • Impersonate another person, business, or government body in your sender ID or message content.
  • Send messages that are fraudulent, threatening, abusive, or harassing.
  • Distribute malware, phishing links, or any content designed to deceive recipients.
  • Violate any applicable Ugandan or East African telecommunications law or regulation, including the Uganda Communications Commission (UCC) guidelines on bulk SMS.

We may review message content and sender ID requests to ensure compliance. Messages that violate these rules may be blocked without notice, and accounts may be suspended.

4. Sender IDs

A custom sender ID (the name or number that appears as the sender) must represent your actual business or organisation. You cannot register a sender ID that belongs to another entity without written authorisation. Requests are reviewed and may take up to 3 business days.

5. Service Availability

We aim to keep the Platform available at all times but cannot guarantee uninterrupted service. Delivery of messages also depends on the downstream mobile networks (MTN, Airtel, etc.), which are outside our direct control. We are not liable for delivery failures caused by network issues, recipient device status, or factors beyond our infrastructure.

6. Limitation of Liability

To the maximum extent permitted by law, SMS Mobilo is not liable for indirect, incidental, or consequential damages arising from your use of the Platform — including lost business, failed campaigns, or data loss. Our total liability in any matter is limited to the value of credits in your wallet at the time of the incident.

7. Changes to These Terms

We may update these terms from time to time. When we do, we will update the date at the top of this page and notify active users by email or platform notification. Continued use of the Platform after changes take effect means you accept the updated terms.
